The Agriculture Improvement Act of 2018 (commonly known as the 2018 Farm Bill) established a federal framework for the cultivation and production of hemp in the United States.

Under federal law, hemp is defined as Cannabis sativa L. and any part of that plant, including its cannabinoids, extracts, derivatives, and other naturally occurring compounds, containing no more than 0.3% Delta-9 tetrahydrocannabinol (THC) on a dry-weight basis.

The 2018 Farm Bill removed hemp, as defined above, from the federal Controlled Substances Act and authorized its production under approved federal, state, or tribal regulatory programs.

The United States Department of Agriculture (USDA) oversees the federal hemp production program, while the U.S. Food and Drug Administration (FDA) maintains authority over products intended for human and animal consumption.

State Regulations

Although hemp is federally regulated, individual states and federally recognized Native American tribes may establish additional laws regarding the cultivation, processing, transportation, sale, possession, and use of hemp-derived products.

As a result, hemp laws can vary significantly from one jurisdiction to another.

State regulations may include:
